What’s In A Disclaimer? Park City Mountain Resort Pass Buyers Hope ‘Nothing’
A troubling dispute between Utah’s Park City Mountain Resort (PCMR) and Talisker Land Holdings, LLC, owners of Canyons, has resulted in a disclaimer on PCMR season pass purchases.
The disclaimer on the PCMR website and marketing materials reads: “Park City Mountain Resort is confident it will be open for the 2012-2013 season, but in the unlikely event the pending lawsuit against Talisker Land Holdings results in the Resort closing for the season, the Resort will refund the full season pass price paid by holders of 2012-2013 season passes. If the Resort is required in the lawsuit to close for a portion of the 2012-2013 season, the Resort will prorate the refund based on the period the Resort is closed.”
PCMR has been involved in a lawsuit with one of the firms under the Talisker banner since March. The dispute is over PCMR’s lease of land from Talisker Land Holdings. PCMR officials contend that Talisker is interfering with its business or trying to shut down its neighboring competitor. The lawsuit was filed in Third District Court at Silver Summit, though no court hearings have yet been scheduled.
While it is likely PCMR will open for the 2012-13 ski season, the effect of its not doing so would cause serious economic hardship in the community and region. The effect on PCMR’s employees, lodging properties, dining, entertainment, ski and snowboard shops, transportation, and many other businesses, would be significant.
PCMR’s Krista Parry told Utah media outlets the resort was “overwhelmed” by the numbers of season pass buyers who purchased before May 15, the first of the deadlines for lower price points. She predicted sales will end up similar to previous years. Adult, all-mountain passes were on sale starting at $650.
"The last thing you want is for people not to have confidence,” Parry said. “We want to keep reassuring people we will be open next year."
